first_imgA FATHER of five from Co Donegal had a home repossession case adjourned to the New Year – after telling a judge he was worried about Santa.The dad – who we are not naming – has been fighting to keep his Letterkenny home from the clutches of the Educational Building Society for the past two years.A High Court case against him was extended from December to the New Year after the borrower told the judge he had five children and was worried about Santa. The EBS are demanding the repayment of two loans taken out five years ago and the homeowner says he only took the case…on the advice of the building society.He argued (and some would agree) that the EBS advised him to take the commercial loans and that the company should be treated as a failed investor and take its own losses.The property involved was “not just a folio number on a piece of paper”, he told Ms Justice Elizabeth Dunne, and he wanted a hearing to look at the loans“This is my life we’re dealing with,” he said. Counsel for the EBS said the case had been ongoing for two years and urged the judge to finish the case.The judge adjourned the case to December 19, but the Letterkenny dad asked if she would hold off until the New Year. He said he had five children and was worried about Santa.
